Planning a reduction under the New York WARN Act
New York’s WARN Act is stricter than the federal law. It generally applies to employers with 50 or more full-time employees in the state and requires 90 days’ notice before a plant closing affecting 25 or more employees, or a mass layoff of 25 or more full-time employees (at least a third of the site) or 250 or more. Notice also goes to local workforce development boards. That long notice period is a good window to start outplacement.
